Terms and conditions

1. Rental period

Rental prices are calculated for the entire duration of the contract. Rates are calculated at a daily rate per rental day. Saturdays and Sundays count as one rental day, except in the case of delays. No refunds will be made if items are returned before the contract end date.

2. Extension

The client agrees to notify La Nouvelle Tablée as soon as possible if he/she wishes to extend the rental period (at least 24 hours before the planned return date). In this case, the client must obtain written authorization from La Nouvelle Tablée and a new invoice will be issued, which must be paid immediately.

3. Delay

If La Nouvelle Tablée's equipment is not returned by the contract end date, the client agrees to pay additional rental charges corresponding to a daily rate for each additional day, notwithstanding any special weekend or long-term rental rate, which will not apply to the rate paid in the event of a delay. The rate is for the entire day and cannot be divided by the hour.

4. Delivery & Access

The client undertakes to provide La Nouvelle Tablée with any passes, access codes or other relevant information required for delivery. It is the client's responsibility to ensure that the equipment fits within the doors.

The transportation fee includes delivery and pick-up of the equipment by La Nouvelle Tablée on the first floor, within thirty (30) meters of the nearest parking lot (the "Delivery Location").

Delivery charges include delivery within regular business hours, i.e. from 7 a.m. to 5 p.m. on weekdays. Additional charges of $60 per hour will apply for deliveries outside these hours. (min. $300 per truck)

Additional charges of $60 per hour per employee will apply in the event of unplanned stairway(s) or waiting time beyond La Nouvelle Tablée's control (min $200 per truck).

5. Payment

a. For clients without a 30-day net account:

Deposit - An initial, non-refundable deposit of 50% of the order total is required to proceed with equipment reservation as well as for all custom orders. Any additions to the reservation must be followed by a deposit.

Balance - The balance of the rental contract must be paid no later than 72 hours before the date of delivery or taking possession, failing which La Nouvelle Tablée will not deliver the goods and the deposit will not be refunded. Full payment is required for all orders scheduled for less than 72 hours.

Payment methods - Payment may be made by credit card, Interac transfer or bank transfer.

Client who are consumers within the meaning of the Consumer Protection Act must pay by credit card in order to comply with its specific requirements.

Hold - La Nouvelle Tablée may require a temporary credit card hold of up to $250. This amount is to guarantee the return of the equipment in good condition and will be held until La Nouvelle Tablée receives the rented equipment.

In addition to this period, each bank normally takes 3 to 5 business days to clear the hold from the account. Contact your bank directly for more information.

b. For client's with a 30-day net account

All accounts with unpaid invoices after the expiry of the 30-day period will have their preferential discount withdrawn on any invoice due, and interest will be charged at the rate of 2% per month.

c. General

NSF cheques will incur a $35 charge plus interest.

Identification may be required to complete the transaction.

6. Cancellation

The initial deposit is non-refundable at any time and for any reason. If cancellation is made 72 hours or less before the scheduled delivery or pick-up date, the client agrees to pay the balance of the contract in full.

7. Termination of contract

La Nouvelle Tablée reserves the right to terminate and take back the rented equipment without notice or formal notice in any of the following cases:

  • If the client fails to pay any amount due under this contract;
  • If the client misuses the goods;
  • If the client initiates insolvency or bankruptcy proceedings under any law;
  • If the client contravenes any of the other provisions of this contract.

In all cases, termination and repossession of the equipment shall not have the effect of extinguishing the client's obligation to pay all sums due and unpaid and all sums to come.

8. Use of equipment

The client may use the rented equipment only in accordance with the terms and conditions of this contract. The cient may not move the items to another location without the written consent of La Nouvelle Tablée.

Rental items remain the responsibility of the customer from the time of delivery or taking possession until they are returned to La Nouvelle Tablée. The customer warrants that the equipment will be used in a proper manner and will be responsible for all damage to said equipment, subject to the application of the damage waiver.

The equipment remains at all times the exclusive property of La Nouvelle Tablée and the client has no right, title or interest in or to the rented equipment other than as set forth in this contract. The client may not sublease the items to another person or to a third party.

The customer shall reimburse La Nouvelle Tablée for amounts paid and expenses incurred in rectifying any breach of this article.

9. Verification, maintenance & shortages

The client must be present at the time of delivery to verify the items immediately upon taking possession, and must notify a La Nouvelle Tablée representative of any defects or missing items immediately. Outside regular business hours, the client may leave a voicemail or e-mail message with the representative, or call one of the emergency numbers listed above. If no notice is given within 4 hours, the items will be presumed to be in good working order.

The client may not, for any reason, modify or alter the items specified in the contract. It is not permitted to hang, staple, cut, drill, fix or make any other modifications to the items in question.

Transportation charges do not include set-up or dismantling of equipment. The equipment must be assembled at the Place of Delivery, in the manner and condition in which it was delivered, failing which the assembly/disassembly charges stipulated in the appendix hereto will be applied automatically. The customer is also responsible for ensuring that the equipment is complete when it is returned.

For any missing item, the late fees stipulated in article 3 hereof will apply. After 5 days of invoiced delay, the cost of the item will be invoiced to the customer in its entirety and will be payable immediately. Any item returned following such invoicing will be credited to the client against any unpaid amount due.

Any trip made by La Nouvelle Tablée to retrieve missing items will also be charged an additional transportation fee to the amount specified in the reservation.

10. Damage waiver

An additional charge of 9.75% of the total cost of the reservation is applicable to all reservations to cover accidental breakage and damage. For any breakage or accidental damage whose repair or replacement exceeds this threshold, the balance of the price will be invoiced to the client.

Notwithstanding the billing of this amount, the client will be required to compensate La Nouvelle Tablée for any breakage or damage to crockery and glassware in excess of a tolerance limit of 5% of the quantity.

The client must return damaged items with the exception of tableware and glassware, which may be sharp. The client agrees to notify La Nouvelle Tablée immediately of any breakage or damage.

Vandalism, loss, theft, fire, negligence, breakage due to bad weather as well as handling breakage (transportation services) are not part of the damage waiver and will be billed according to the repair costs or selling price established by La Nouvelle Tablée.

11. Liability

La Nouvelle Tablée accepts no liability for damage or any other form of loss resulting from the installation or use of the equipment by the client.

La Nouvelle Tablée cannot be held responsible for any damage caused to the site or any delay due to extreme weather conditions or any other force majeure.

12. Marquee

a. Information required

The client must be sure to provide La Nouvelle Tablée's representative with the required information regarding soil composition to avoid any unforeseen problems during installation, at the time of submission.

Standard installation with stakes is possible on gravel, grass and asphalt. The client must inform La Nouvelle Tablée of any other ground compositions, otherwise it may not be possible to install the tent. La Nouvelle Tablée will then not be obliged to rent and install the tent, but the contract will continue for the other items, if applicable. The provisions of article 6 regarding cancellation will apply, and the client will still be required to pay for the tent.

The customer must ensure that he has all information concerning conduits, wires or any other installation under the site to a depth of 35 inches.

b. Preparation and use

The client must prepare the space and ensure that at least 2 feet of space are left on each side of the tent during delivery and return. The client must indicate the exact location where the tent is to be set up to the delivery personnel upon delivery, or to La Nouvelle Tablée's representative beforehand, before the installation team arrives. Any wait by the installation team will result in a charge of $60 per hour per installer.

The client must ensure that a space of one foot is left between the roof or sides of the tent and any heating, lighting or other equipment that could damage the tent.

In high winds, the client must open all four walls to allow the wind to circulate.

c. Site visit

If the customer so desires, or if La Nouvelle Tablée deems it necessary, the premises may be visited prior to installation, and a visit fee of $250 will be charged for any visit to a location within a 50 km radius of La Nouvelle Tablée's discretion and according to the terms and conditions deemed appropriate by La Nouvelle Tablée. Once paid, these charges will be credited to the final rental order. Any visit to a more distant location will be at La Nouvelle Tablée's discretion and according to La Nouvelle Tablée's terms and conditions.
